The Economic and Financial Crimes Commission (EFCC) has decided to withdraw its appeal against an order from the Kogi High Court preventing it from arresting the immediate past Governor of Kogi State, Yahaya Bello.
The EFCC filed a notice of withdrawal on April 22, stating that events had rendered the appeal irrelevant.
In the notice, the EFCC admitted that the appeal was filed after the allowed time under the law. The notice stated, “The appellant herein intends to and do hereby wholly withdraw her appeal against the respondent in the above-mentioned appeal.”
The EFCC’s decision to withdraw the appeal was based on the fact that a recent decision by the Kogi High Court, made on April 17, 2024, had already addressed the matter.
The orders made by the court on February 9, 2024, were meant to remain in effect until the court could hear and rule on the originating motion. The court finally determined this motion on April 17, 2024.
Furthermore, the EFCC acknowledged that its notice of appeal was filed after the legal deadline and, therefore, asked for the appeal to be struck out on the grounds of being filed out of time and incompetent.
